Welcome to Fairytale Adventures! These Terms of Service ("Terms") govern your access to and use of the Fairytale Adventures website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. Please read these Terms carefully before using Fairytale Adventures.

Fairytale Adventures is an AI-powered platform that creates personalized children's storybooks and illustrations. The Service allows parents and guardians to:

• Create custom characters based on their children (name, age, appearance, personality).
• Generate unique, AI-written stories featuring their children as heroes.
• Receive AI-generated illustrations for each page of every story.
• Save, view, and share stories within their account library.
• Download stories as PDFs or order printed books shipped within the EU and the UK.

You must be at least 18 years old to use Fairytale. You confirm at sign-up that you are an adult and that, where you use a child's name or likeness in the characters or stories you create, you are the parent or legal guardian of that child or otherwise have the right and consent to do so. Characters are fictional storybook characters; the names, ages, and descriptions you provide are used solely to produce the personalized storybook you have requested.

Plans and Purchases

Fairytale Adventures offers monthly and annual subscriptions, and one-time purchases. Family subscribers also receive free previews. Current pricing is shown on the pricing page and at checkout. We reserve the right to modify our pricing at any time with reasonable notice.

• Free preview (Family subscribers only): a preview of one book (the cover plus 2 inner pages). 3 free previews per month, on both the monthly and the yearly plan.
• Family Subscription (monthly): €24.90 per month for 5 digital books per month, 3 free previews per month, premium themes, premium art styles, 15% off every printed book, and up to 12 hero + 12 buddy character profiles. Unused books do not roll over to the next month.
• Family Subscription (annual): €249.90 per year (about 16% off), same benefits as monthly with annual prepayment.
• One-time digital purchase: from €3.90 per book (length-tiered: €3.90 / €4.90 / €5.90 / €6.90 for 12 / 16 / 20 / 24 pages). PDF download, kept in your library forever.
• Printed book add-on (separate purchase once the digital book is ready): from €11.90 + shipping for softcover (12-24 pages); 24-page books are also available as A5 hardcover from €19.90. Printed books ship within the EU and the UK in 5 to 10 business days; digital is delivered immediately.

Billing

• All payments are processed securely through Stripe.
• Subscription billing renews automatically (monthly or annually depending on your plan) until you cancel from your Account page. Cancellation takes effect at the end of the current billing period.
• You authorize us to charge your payment method for the applicable amount.
• Prices are listed in EUR unless otherwise specified.

Refunds

• Because each book is uniquely generated and delivered to you immediately upon order, by completing checkout you expressly request immediate performance and acknowledge that you waive your right of withdrawal for digital content under applicable EU consumer law. Refunds on digital books are therefore not generally available.
• For printed books with manufacturing defects or shipping damage, we offer replacements at no extra cost when you contact us within 14 days of delivery. We do not refund subjective complaints about the generated story or illustrations (the digital book has already been delivered).
• Refund requests are handled on a case-by-case basis at our reasonable discretion.

Your Content

You retain ownership of any content you provide to the Service, including character names, descriptions, and any uploaded images. By providing this content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it solely for the purpose of generating your books.

Generated Stories

• Stories and illustrations generated by our AI are created specifically for you.
• You receive a personal, non-exclusive license to use, share, and print your generated stories for personal, non-commercial purposes.
• You may not sell, redistribute, or commercially exploit generated content without our prior written permission.
• We may use anonymized, aggregated data to improve the Service.

Fairytale Adventures Property

The Fairytale Adventures name, logo, website design, prompts, and underlying technology are our intellectual property and may not be copied, modified, or used without our written permission.

You agree not to use the Service to:

• Create content that is inappropriate, harmful, or not suitable for children.
• Attempt to generate violent, hateful, sexual, or discriminatory content.
• Upload images or descriptions of real people that you do not have the right to use (or, for minors, without the consent of a parent or guardian).
• Impersonate another person or misrepresent your relationship to a child featured in a book.
• Attempt to circumvent content moderation, rate limits, quotas, or any other technical restrictions.
• Use automated tools (bots, scrapers, crawlers) to access the Service without permission.
• Interfere with the proper functioning of the Service or with other users.
• Violate any applicable law, regulation, or third-party right.

We reserve the right to suspend or terminate accounts that violate these policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk. This does not affect any non-waivable consumer rights you may have under the law of your country of residence.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRYTALE ADVENTURES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Fairytale Adventures and its officers, directors, employees, contractors, and partners from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

• You may terminate your account at any time from the Account page or by contacting us.
• We may suspend or terminate your account if you violate these Terms or applicable law, or if your account shows evidence of fraudulent activity.
• Upon termination, your right to use the Service ceases immediately.
• We may retain certain data as required by law (for example, payment records for tax and accounting purposes) or for legitimate business purposes such as fraud prevention and dispute resolution.

We may update these Terms from time to time to reflect changes in the Service, our business, or applicable law. Material changes will be communicated by email and posted on this page at least 14 days before they take effect, and the "Last updated" date will be revised.

Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you may delete your account before they take effect.

These Terms are governed by the laws of the European Union and of the country where Fairytale Adventures is established, without regard to conflict-of-law principles. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the competent courts of our place of business.

Nothing in these Terms limits any mandatory consumer protection rights you may have under the law of your country of residence.
